These Terms & Conditions govern the use of the Sims Freight & Logistics website and general interactions with Sims Freight & Logistics. Specific freight transactions may also be governed by separate written agreements, rate confirmations, carrier agreements, shipper agreements, bills of lading, or other transaction-specific documents.
Freight Brokerage Services
Sims Freight & Logistics provides freight brokerage and logistics coordination services. When acting as a property broker, Sims Freight & Logistics arranges transportation between customers and authorized motor carriers.
Unless specifically agreed otherwise in writing, Sims Freight & Logistics does not represent that it is the motor carrier physically transporting a shipment.
Quotes and Rates
Freight quotes are based on information available when the quote is provided and may be subject to change if shipment details change.
Changes involving weight, dimensions, commodity, equipment requirements, pickup or delivery locations, dates, accessorial services, detention, layover, lumper services, additional stops, reconsignment, storage, or other shipment circumstances may result in additional charges.
A website quote or inquiry does not by itself guarantee equipment availability or create a binding transportation agreement.
Shipment Information
Customers are responsible for providing accurate shipment information, including commodity, weight, dimensions, quantity, pickup and delivery information, special handling requirements, and other information reasonably necessary to arrange transportation.
Customers must disclose hazardous, restricted, high-value, temperature-sensitive, or otherwise specially regulated commodities before transportation is arranged.
Motor Carriers
Sims Freight & Logistics may arrange transportation with independent motor carriers.
Motor carriers are independent businesses and are not employees of Sims Freight & Logistics solely because transportation has been arranged through our brokerage services.
Carrier qualification, insurance, operating authority, and other requirements may be reviewed as part of our carrier-selection and onboarding processes.
Pickup and Delivery
Requested pickup and delivery dates or times may be estimates unless expressly agreed otherwise in writing.
Transportation may be affected by traffic, weather, mechanical issues, facility delays, government actions, road conditions, emergencies, acts of God, or other circumstances outside the reasonable control of Sims Freight & Logistics.
Accessorial Charges
Additional services or circumstances may result in additional charges, including detention, layover, truck ordered not used, lumper charges, storage, reconsignment, additional stops, redelivery, special equipment, loading or unloading delays, and other accessorial services.
Applicable charges may depend upon the circumstances of the individual shipment and the governing transaction documents.
Cargo Claims
Cargo loss or damage should be reported promptly.
Claims involving cargo loss, shortage, or damage may be subject to applicable law and the terms of the relevant transportation documents, agreements, and carrier requirements.
Nothing on this website is intended to modify legal rights or obligations applicable to a particular shipment.
Payment
Customers are responsible for paying amounts due according to the applicable invoice, rate confirmation, agreement, or other transaction documents.
Payment requirements applicable to a particular shipment or customer relationship will be determined by the governing transaction documents.
Website Information
We attempt to keep information on this website accurate and current, but website content is provided for general informational purposes and may be changed without notice.
Submission of a website form does not, by itself, create a broker-carrier, shipper-broker, or other contractual relationship.
