TERMS & CONDITIONS

 SIMS FREIGHT & LOGISTICS

 Effective Date: September 18, 2026

1. ACCEPTANCE OF TERMS

By accessing SIMSLOGS.COM, requesting a freight quote, submitting shipment information, or using services provided by SIMS Freight & Logistics (“SIMS”), you agree to these Terms & Conditions. If you do not agree, please do not use our services.

2. FREIGHT BROKERAGE SERVICES

SIMS Freight & Logistics provides freight brokerage, logistics coordination, and transportation-related services. SIMS may arrange transportation with independent motor carriers and other transportation providers. Unless expressly agreed otherwise in writing, SIMS acts as a transportation broker and not as the motor carrier transporting the shipment.

3. FREIGHT QUOTES & QUICK QUOTE ESTIMATES

Rates generated through the SIMS Quick Quote tool are estimates only and are not guaranteed rates or binding offers. Final pricing is subject to verification of shipment details, mileage, equipment requirements, commodity, weight, dimensions, pickup and delivery requirements, market conditions, and carrier availability.

A shipment is not considered booked solely because a customer receives or submits an online estimate. SIMS must confirm the shipment and final rate.

4. CUSTOMER INFORMATION

Customers are responsible for providing complete and accurate shipment information, including pickup and delivery locations, commodity, weight, dimensions, pallet count, equipment requirements, special handling requirements, and applicable pickup and delivery dates.

Additional charges may apply when information supplied by the customer is incomplete or inaccurate or when shipment conditions change.

5. ACCESSORIAL & ADDITIONAL CHARGES

Additional charges may apply for services or circumstances including, where applicable, detention, layover, truck ordered not used, redelivery, reconsignment, additional stops, driver assistance, lumper services, storage, limited-access locations, residential service, liftgate service, oversized or overweight freight, and other services not included in the confirmed rate.

6. PICKUP & DELIVERY

Pickup and delivery dates and times are estimates unless SIMS expressly agrees otherwise in writing. Delays may occur because of weather, traffic, equipment issues, shipper or receiver delays, carrier availability, government actions, or other circumstances outside SIMS's reasonable control.

7. CANCELLATIONS

Customers should notify SIMS immediately if a shipment must be canceled or changed. Cancellation, truck-ordered-not-used, detention, or other applicable charges may be assessed when a carrier has already been dispatched or committed to the shipment.

8. CARGO CLAIMS, LOSS & DAMAGE

Any cargo shortage, loss, or damage should be reported promptly to SIMS and documented appropriately. Cargo claims may be subject to applicable carrier terms, bills of lading, contracts, tariffs, insurance coverage, and federal or state law. SIMS will reasonably assist customers with communication and documentation relating to claims involving the transporting carrier.

9. PROHIBITED OR RESTRICTED FREIGHT

Customers must disclose hazardous materials, regulated commodities, high-value freight, temperature-controlled requirements, oversized freight, and other special transportation requirements before booking. SIMS may decline any shipment that cannot be legally or safely arranged.

10. PAYMENT

Customers are responsible for paying all agreed freight charges and authorized additional charges according to the payment terms provided by SIMS. Failure to pay amounts when due may result in collection activity and suspension of services, subject to applicable law and any written agreement between the parties.

11. INDEPENDENT CARRIERS

Motor carriers arranged through SIMS operate as independent businesses and are not employees of SIMS. Carriers are responsible for operating their vehicles, drivers, equipment, and transportation services in accordance with applicable laws and their contractual obligations.

12. LIMITATION OF LIABILITY

To the extent permitted by applicable law and subject to any controlling written agreement, SIMS will not be responsible for indirect, incidental, special, exemplary, or consequential damages arising from use of the website, Quick Quote tool, or brokerage services. Nothing in these Terms is intended to exclude liability that cannot legally be excluded or limited.

13. WEBSITE & ELECTRONIC COMMUNICATIONS

Information provided on SIMSLOGS.COM is provided for general business and informational purposes. By submitting forms through the website, you authorize SIMS to contact you regarding your quote, shipment, requested services, or related business communications using the contact information you provide.

14. PRIVACY

Personal information submitted through the website is handled in accordance with the SIMS Freight & Logistics Privacy Policy.

15. CHANGES TO THESE TERMS

SIMS may update these Terms & Conditions from time to time. Updated terms will be posted on SIMSLOGS.COM with a revised effective date. Changes apply prospectively as permitted by applicable law.

16. GOVERNING LAW

These Terms & Conditions are governed by applicable federal law and the laws of the State of Texas, without regard to conflict-of-law principles, except where another law is required to apply.
